Terms of Use – Funzy World

Welcome to Funzy World, your online home for superfans where celebs and their fans can interact in the most innovative way. 

We are happy to be your platform that connects you and other fans with artists, performers, social media icons and various celebrities ("Artists") so you can interact using the Site or directly with them. 

PLEASE READ ALL OF THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN IMPORTANT LEGAL INFORMATION REGARDING YOUR RIGHTS, DUTIES, SCOPE OF REMEDIES, ETC., WHICH YOU WILL BE BOUND BY AS A LEGAL AGREEMENT.

ANY USE OF ANY KIND OF THE SITE, ANY APPLICATION, ANY FIGURINEOR OTHER MERCHANDISE OR ANY OF THEIR SERVICES (INCLUDING CREATING CELEBRITY INTERACTIONS OF SORTS) SHALL CONSTITUTE AN AGREEMENT TO THESE TERMS. PLEASE DO NOT MAKE ANY OF THE ABOVE UNLESS YOU AGREE TO THE TERMS AS DEFINED HEREIN.

In these Terms, "the Site" (also referred to as "we," "us," or "our") encompasses the website located at https://funzy.world, any related applications—including but not limited to the Funzy App and the Funzy – Eyal Golan App—and all associated services. This definition also includes, where applicable, the owners of the Site, its managing entities, operators, directors, employees, shareholders, affiliates, and any authorized representatives.

Modifications to the Terms. You should check the Terms (as defined below) periodically for modifications. We may modify the Terms from time to time without notice. If We make material changes to the Terms, we will post the revised Terms and the effective date thereof on the Site or notify you by e-mail, but we may not do so at our own discretion. Any continued use by you of the Site (including any of the Apps or their Services) after the posting of such modified Terms shall be deemed to indicate your explicit agreement to such modified Terms. Accordingly, if at any time you do not agree to be subject to any modified Terms, you should no longer use the Service or the Site.

Our Purpose

  • Our Site and services are designed to allow you and other fans to follow your favorite Artists, interact with them, receive various content and products from them, participate in their off-line and online activities, etc. Therefor we supply Artists you chose to follow with various data and information about you about you and try to allow open, direct and enjoyable interactions and connections between the Artists and yourself.
  • After such interaction has started, the Artists and you may interact through the Site or off the Site, all as you may chose fit. We do not take any part of such interaction, unless otherwise specifically stated on the Site.

Term and validity

  • The Terms. These Terms, the Privacy Policy https://www.funzy.world/privacy-policy of the Site and any other policy, guidelines or terms published by the Site or applying to any application, service, order or purchase, together or separately, as relevant, hereby - the "Terms". 
  • The Terms shall remain in full power at any time as long as they are relevant. Terminating your account does not terminate the applicability of the Terms to you.
  • Use of the Site by Persons Under 16 Years of Age is prohibited:  Accordingly, children under the age of 16 may not use the Site for purchases, and if done so – their use may be prohibited and limited with no prior notice.

Registration to the Site 

  • Our services may or may not be free. We may, at any time and regarding any service or product, decide whether such service or product is free of charge or is not free of charge. Such a decision may change from time to time.
  • The Figurines and the interactions. We may use (sell) figurines or other artifacts (any and all of them hereunder - the "Figurines") to allow you direct and quick enrollment to the Site. Their sole purpose is to allow more direct interaction between you and your favorite celeb-persons, Artists. You may use such Figurines to receive personal or other content and interact with your favorite Artists. Some of the Artists' content and offers may be public and other personally suited to their fans or to you specifically. The Artists themselves are the ones managing their relationships, and the Site is simply a platform to allow those interactions (and does not control them).
  • Registration to the Site.  To follow an Artist, accept and view her content or interact with her and her team, you may be required to use the "Celeb Figurine" you have achieved and open your own account. You may connect various Figurines to your account, one per each Artist you may want to follow and interact with. 

To remove any doubt, on various occasions registration to the Site will be allowed without using a Figurine (or for example by using a relevant code instead), yet all the Terms herein apply to such registration as well. Following an Artist will be made directly by your own choice, in such instances.

  • Upon registration you will be requested to choose a unique username and a personal password (which shall remain encrypted and will not be available to us). You may also be requested to enter various data to be used by us while managing your enjoyment from the Site and shared with various Artists you follow. Upon registering your account, you agree -
  1. That you understand that everything you upload or share to your account may be shared with the Site and the relevant Artists you may follow and their staff. Anything you post in any public forum may be viewed by any user of the Site;
  2. That supplying any such information is not mandatory, is pursuant to your own agreement and wishes, and that the Site and Artists may use any such information to promote the Site, The Artist or your interactions with them;
  3. that the information you provide the Site or Artists with will be current, complete and accurate;
  4. that you will not take any screenshots or other recordings of materials and content and Works you accept from the Site. Such content and Works may be copyright protected and you hold the non-exclusive and revocable license to privately view each such content and Work.  No other use is licensed. Any un-licensed use of any content or Work (either from the Site or from the Artists directly) shall result in automatic termination of your license.
  5. not to transfer, sell, convey or assign the right to use your account to any third party; 
  6. not to permit any third party to use your username and password or your Figurine in order to access your account. You further agree that you are responsible for the conduct of any party that uses your account or Figurine, whether or not authorized by you, and for any breach of security related thereto.
  • Any activity in your account, Figurine and your details is your own responsibility. Please check carefully any details you submit to the Site, as the Site will act based on them. Wrong, outdated, incomplete or otherwise incorrect information might cause undesirable results. Also, use of your Figurine by third party may harm your privacy, your enjoyment from the Site or the interaction with the Artists you choose to follow. You are requested to keep your password, Figurine and any other private data as confidential, as you will be the sole liable for anything occurring within your account, even if not executed by yourself.
  • Registration may be denied. The Site reserves the right, but is under no duty or representation, to review any and each of the registration requests, and deny any of such requests subject to its own discretion and with no explanation or notice supplied. If you do not agree, please do not register to the Site. In some instances, the Site might not allow any registration or specific purchase based on its sole discretion and with no explanation supplied. You shall have no complaint or claim against the Site in such a case. 
  • Grant of Rights. Upon registering (and subject to an accepted or proper use of the Figurine and the Site's interface) the Site grants you a limited, revocable, non-transferable, non-exclusive right to access and use the Site, if such activity is solely for your personal purposes.
  • Password and Figurine are and must be kept private. It is your responsibility to keep your password and your Figurine private and confidential (as relevant). Any use or misuse of the password or of your Figurine shall be your responsibility alone. 

If you suspect unauthorized use of your Account, PLEASE notify us immediately (at our "contact us" page https://www.funzy.world/contact (subject: Unauthorized use of my account), and supply us with enough information both to base your suspicion and your ownership of the Account as per our discretion. Also please change your password immediately.

Use of the Site and the Figurine

  • Use of the Figurine. Each Figurine you may get is embedded with NFC component that the Site (including its App.) may recognize and allocate directly with your own personal account. Such use may make it easier for you to register to the Site or to specific Artists.
  • Use of the Site. Once you use the Figurine and open an account, the Site will use each Artist's relevant Figurine as an indication you wish to follow that Artist, to accept and enjoy material such Artist posts on the Site, read relevant posts, view relevant video clips, participate in quizzes, sign up to various shows and performances and be exposed to any activity the relevant Artist may allow on the Site. Due to our main purpose, we supply each Artist you may follow with the information you upload to the Site, or the Site had collected about you, as may be relevant.

The Site may allow you various activities, content and interactions, such as (but not limited to) writing on various forums, receiving various content and offers, watching special videos and taking part in unique activities the Artists create.

  • The License granted to you. We hereby grant you a nonexclusive, nontransferable license (limited by the Terms) to access and use the Site in accordance with normal use of its interface. To remove any doubt, the use of the Site is licensed, not sold. 
  • You may not: To the extent permissible by applicable law, you may not, nor may not permit any other person or entity to:
    • Make available to the public, transmit, perform or otherwise distribute in any manner (commercially or privately, for pay or for free) any content or Works either on the Site or delivered to you on behalf of any of the Artists;
    • Sublicense, redistribute or lease any portion of the Site, your account therein or any content included on the Site or supplied by any Artist;
    • Reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Site or create derivative works from any of the Services or surveys;
    • Reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any use of or access to the Site; or
    • Copy, reproduce, capture, store, retransmit, distribute or otherwise make any use not in accordance with the Site's interface or while removing the Site's logo, of any content included within.
  • Conduct prohibited. The following is a non-inclusive list of the kinds of conduct that is forbidden on the Site, including conduct that is - 
  1. Illegal or unauthorized use of the Site, including but not limited to intellectual property breach, and any other illegal, breaching, damaging, harmful or inappropriate activity;
  2. harassing, stalking or advocating harassment or stalking of another person or group of individuals;
  3. solicits passwords or other personal information (such as addresses, social security numbers, etc.) from other users;
  4. attempting to impersonate another person or opening an Account under false name, characteristics or pretences;
  5. using the account, username, Figurine or password of another at any time or disclosing your password to any third party or permitting any third party to access your account or your Figurine;
  6. accessing data or code that is not intended for the users of the Site, or gaining unauthorized access to an account, Figurine, server or any other computer system;
  7. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures;
  8. any automated use of or access to the Site (or any code or Figurine), including but not limited "bots", "robots", "spiders", etc. that accesses the Site in a manner that sends request messages to the Site's servers more than a human can reasonably produce in the same period of time by using a conventional on-line web browser. 
  9. attempting or interfering with the function of the Site, Service, host or network, including, without limitation, via means of submitting a virus to the Site or its users, overloading, "flooding", "mailbombing", "crashing", "ddos attacks", "malware" or sending unsolicited e-mail, including promotions and/or advertising of products or Service;
  10. circumventing, disabling or otherwise interfering with security-related features or other digital-rights-management features of the Site.

  • You may not alter or modify in any way or manner any part of the Site, its look-and-feel, interface, advertisements, code, printouts, content, Works included or any of its related technologies or the surveys within.
  • To remove any doubt, we do not undertake to keep ay back-up or allow free and continuous access to any content or Work contained on the Site or supplied by the Artists (including tickets for shows). You are kindly requested to download or keep a copy for any such content you do not wish to lose (except protected Works, to which you can act as in accordance with the law).

Proprietary Rights and Intellectual Property

  • Copyright of the Site. The Site is and includes copyright protected works and protected trademarks. You may not modify, distribute, copy, frame, republish, display, post, publish, reproduce, sell or make any other use in any way of any content or part of the Site or any trademark therein.  
  • Artists' Works and content and limitation of license. The Site may include, or you may receive or be exposed to, various content and protected works (herein: "Works"). The copyrights in said Works are held by third parties, such as Artists or various others. You will receive access to said Works as a valued member of the Site or holder of a relevant Figurine. Nevertheless, we wish to specifically state that such access grants only limited, non exclusive, revocable license and you may not make any use of said Works except personal enjoyment.

Artists Content, Works and interactions

  • Information will be shared with Artists. The main purpose of the Site is to allow direct connectivity and interactions directly between you, selected Artists and their staff. For that reason, all information supplied to us may be shared with your selected Artist as well.
  • Artists use the information without the Site's control. It is specifically agreed that once your information is supplied to any Artist and her staff, any use of such information, and any activity of, or interaction with, such Artist is not controlled by the Site. Sole responsibility and liability relating to any such activity is solely by the hands of the relevant Artist or anyone acting on his behalf.

User Generated Content

  • User Content. You represent and undertake that you own all rights in and to any content (like messages, photo, video, text and other content or works) uploaded by you to the Site or its services, including any designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, literary works, musical works and any other materials (“User Content”), or otherwise have (and will continue to have) the full power, title, licenses, consents and authority, in and to your User Content, as necessary to legally use, publish, transfer or license any and all rights and interests in and to such User Content.
  • The User Content is (and will continue to be) true, current, accurate, non-infringing upon any third party rights, and in no way unlawful for you to possess, post, transmit or display.
  • We do not undertake to review and scan such User Content and you hold the sole responsibility to any such User Content. 
  • You have obtained all consents and permissions required under all applicable laws, regarding the posting, transmission and publication of any personal information and/or image or likeness of any person, entity or property which is part of the User Content, and you will adhere to all laws applicable thereto.
  • You further allow the Site and anyone on its behalf free, unlimited, non-exclusive license to use any such User Content on the Site, by the Artist or for the distribution and marketing of the Site.

Termination

  • Termination of specific accounts. The Site may terminate any account or membership, delete any profile and/or prohibit any user from using or accessing the Site or any purchase within, in whole or any part thereof, for any reason, for no reason, at any time in its sole discretion, with or without notice. 
  • Termination of the Site or any of its Services. The Site may also terminate its operations, all or any part thereof (including any of its services or Figurines), permanently or temporarily at its own discretion. The Site does not issue any warranty for continuance of any or all services or products and may terminate any or all of them at its own discretion, without notice and at any time. 
  • No remedies upon termination. To remove any doubt, you will not be awarded any remedy of any kind if the Site has terminated your account, your Figurine, any of its Services or its activity altogether and you have no claim against the Site in any of these cases.

Credit Cards and other Payment Methods

  • Any payment to the Site or to any of the Artists within the Site, is made by and to third parties payment processing services (such as Apple or Google payments, etc.). Before proceeding to check out please review their individual privacy policies (as appearing next to the payment box), their payment conditions and their payment methods. Please never use one which you do not feel comfortable or agree with. We (the Site) will not be responsible for the actions and policies of such third parties.
  • Your credit card details are not shared with us. 
  • Please be sure to provide your exact details of payment method and your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order and might not allow us to process it to your satisfaction.

Breaches of you rights and Take-Down Procedure

  • We respect the intellectual property rights of others.

The Site includes various content and Works (protected or not). If your copyrighted works were used inappropriately by any of our users or Artists, on the Site, please let us know and provide us with all the relevant information (using this email: support@funzy.world) so we can deal with it in accordance to any relevant law.

Disclaimers and no liability of the Site

  • We are not the manufacturers of products sold on our Site or by the Artists and not the creators of any content or Work (unless otherwise specifically stated). Therefore, when we have no knowledge of the terms of each interaction or transaction, and we are not liable to anything related thereto.
  • USE THE SITE AT YOUR SOLE RISK. YOU AGREE THAT THE USE OF THE SITE, ANY OF ITS SERVICES AND ANY INTERACTION WITH ANY OF THE ARTISTS SHALL BE AT YOUR SOLE RISK, TO THE FULLEST EXTENT PERMITTED BY LAW.
  • NO WARRANTEES OF ANY KIND. THE SITE AND ANY PART OF THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND AS AVAILABLE. THE SITE AND ANYONE RELATED TO IT OR ACTING ON ITS BEHALF EXPRESSLY DISCLAIMS ANY WARRANTY, CONDITION OR REPRESENTATION OF ANY KIND (EXPRESS, IMPLIED, ORAL OR WRITTEN), INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, SPECIFIC FUNCTION, FUNCTIONALITY, MERCHANTABILITY, RELIABILITY, AVAILABILITY, QUALITY, PERFORMANCE, NON-INFRINGEMENT, ENJOYMENT, OR OTHER. THE SITE CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE SITE OR THE SERVICE. 
  • SOME JURISDICTIONS PROVIDE CERTAIN WARRANTIES. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL SUCH WARRANTIES, UNLESS MANDATORY UNDER SPECIFIC JURISDIOCTION.
  • NO LIABILITY. IN NO EVENT WILL THE SITE, ITS DIRECTORS, EMPLOYEES, AGENTS OR ANYONE ON ITS BEHALF BE LIABLE TO ANY USER OR THIRD PARTY FOR ANY DIRECT AND INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS, REVENUES OR DATA, FINANCIAL LOSS OR ANY OTHER KIND OF DAMAGES ARISING FROM THE USE OF THE SITE OR ANY OF THE SERVICE, CONTENT (INCLUDING ARTISTS' CONTENT), INTERACTION OR ANY OF THE SITE OR SERVICE OR OTHER CONTENT, ACCESSED THROUGH OR DOWNLOADED FROM THE SITE OR DELIVERED ON BEHALF OF ANY OF THE ARTISTS, EVEN IF THE SITE IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • LIMITATION OF LIABILITY. AS CERTAIN JURISDICTIONS DO NOT ALLOW COMPLETE LIMITATION OF LIABILITY AS ABOVE, OR IN ANY CASE ANY COMPETANT COURT DECIDES THAT FOR ANY REASON THE SITE OR ANYONE ON ITS BEHALF SHALL BE LIABLE TO ANY DAMAGES OF ANY KIND, THE SITE'S (OR ANYONE ON ITS BEHALF) TOTAL LIABILITY DUE TO ANY DAMAGES (DIRECT AND INDIRECT), CLAIMS OR CAUSES OF ANY SORT OR KIND (WHETHER CONTRACTUAL, TORTIOUS OR OTHER), EITHER BY LAW, DUE TO THESE TERMS (INCLUDING IMPLIED WARRANTEES OF ANY KIND) AND FOR ANY OTHER CAUSE WILL BE LIMITED (TO THE EXTENT PERMITTED BY LAW) AND NOT HIGHER THAN THE AMOUNT YOU PAID TO THE SITE TO USE ITS SPECIFIC RELEVANT SERVICE OR FIGURINE AS APPILACBLE, FOR THE PERIOD OF THE PAST 6 MONTHS PRIOR TO THE DAMAGE OCCURANCE.

IN ALL CASES, THE SITE AND ANYONE ON ITS BEHALF WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

  • No liability to Artists' activity or default, omission or negligence. The Artists and anyone on their behalf act independently and under no supervision of the Site. Therefore, the sole liability to any of their action, omissions, negligence, contract breach or any breach of law, shall be solely theirs and the Site shall never be held liable for any such instances.
  • No liability to any error of any kind. The Site may include and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, anything within the Site. 
  • No responsibility for security breaches, malware, fraud or similar faults. As always online, and even though the Site undertakes reasonable security measures as customary, certain security breaches, hacks, cracks, deceit, fraud or other faults (such as viruses and Trojan horse codes) may always happen. We will be under no liability to any such fault.
  • No responsibility for linked materials and websites. The Site will contain links to other websites. The Site is not responsible for any content published on such other sites or opinions expressed on such other sites, including but not limited to their accuracy or their being kept up to date by such sites. Such sites are in no way investigated, monitored or verified for accuracy, completeness or otherwise by the Site. The inclusion of any linked website on the Site does not imply approval or endorsement of the linked site by us. When you access these third-party sites, you do so at your own risk. If any link to such site offends you, causes you any harm or you believe is illegal, please notify us by using the "Report Content" link at the bottom of certain pages, or use the "Contact Us" page.
  • No responsibility for any technical difficulty. The Site will not be responsible for any problems or technical malfunction of any communication network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems, virus and malicious codes or traffic congestion on the Internet or on any of the Service or combination thereof, including any injury or damage to yourself, to any user or to any person's computer related to or resulting from participation or downloading or receiving materials in connection with the Site. 
  • No responsibility to advertisements. The Site assumes no responsibility for third party advertisements (including Artists') which are posted on the Site, nor does it take any responsibility for the goods or services provided by its advertisers or to any warranty or undertaking detailed in such advertisement.

Disputes Resolution

  • Exclusive law and jurisdiction. By using the Site (including any application or otherwise) or any of its services in any manner, you agree that any dispute about or involving the Site, its products or its services shall be exclusively governed by the laws of the State of Israel, without regard to conflict of law provisions and governed by these Terms. In such a case, you agree to an exclusive personal jurisdiction and venue in the competent courts in the district of Tel Aviv, Israel.

Indemnification

  • You shall indemnify and hold the Site, its subsidiaries, and affiliates, and their respective directors, officers, agents, partners, contractors and employees, harmless from any loss, liability, claim, demand, costs, damages or expenses, including reasonable attorneys' fees, made by any third party due to or arising out of the use of the Site or the Service or any of the content, in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth above and/or if any content that you post on the Site or the Service causes the Site to be liable to any third party.

Other

  • Limitation on the Period of Limitation. YOU HEREBY AGREE THAT ALL CLAIM OR CAUSE OF ACTION OF ANY KIND VERSUS THE SITE OR ANYONE ON ITS BEHALF SHALL BE FILED IN A COURT OF LAW WITHIN AND NO LATER THAN TWENTY FOUR (24) MONTHS PAST THE DATE OF ITS OCCURRENCE. THIS SECTION IS TO BE CONSIDERED AS AN AGREED LIMITATION ON THE PERIOD OF LIMITATION UNDER ANY RELEVANT LAW, AND SHALL OVERCOME ANY OTHER LEGAL REQUIREMENT (UNLESS IT IS A MANDATORY LEGAL REQUIREMENT).
  • Entire agreement. These Terms (which include the Site's privacy policy and any other notifications posted on the Site) constitute the entire agreement between you and the Site regarding any kind of use of the Site. 
  • Non waiver of rights. Failure of the Site to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. 
  • Section titles solely for convenience. The section titles in these Terms are for convenience only and have no legal or contractual effect. 
  • The Terms operate to the fullest extent permissible by law. If any provision of these Terms is unlawful, void or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
  • No third party agreement. You agree that, except as otherwise expressly provided in these Terms, there shall be no third party beneficiaries to these Terms.
